1:17 >> In a divorce case, which parent gets to claim the minor children on their income tax return? And typically, it’s the parent who has primary physical custody of the minor children. Unless, otherwise-

1:43 >> So in a divorce case, the parent who has primary physical custody gets to claim the minor children on their income tax return each and every year.
1:51 >> Okay. Now Alex, explain to the people what physical custody means.
1 1:57 >> Meaning that the parent who has primary custody typically exercises visitation with the children 60% of the time.
2:06 >> All right. And so what happens, you guys, is if you guys have between 40 to 60% of the time, between each of you guys, then it’s called joint physical custody. But if one parent has over 60, it’s called primary physical custody, okay. Now, obviously, when you have kids involved in a divorce, people act all types of crazy, Natalie, they act all types of muy loco and locas, don’t they?

2:37 >> Yes, they do. Okay. And so it’s very, very, in case you missed it the first time very important that you make sure that you have your tax claims set up correctly, okay. And Tara, you were just saying something about a tax claim of regarding yourself or another client, right? Tell everybody what you were talking about, like, two minutes ago?

3:06 >> Same si-[clears throat]. Excuse me. Same situation, my now ex-husband has wanted to be able to claim two of my children and thankfully the judge told them no, because I have primary physical custody of all four of my children.

3:25 >> So the biggest thing- Oh, make sure I’m not too close. Haha. The biggest thing, you guys, is to make sure that you have all of that; your terms regarding your divorce, make sure that you have all that situated. Okay. The best thing that you can do is make sure that you’re in agreement with your soon to be ex spouse and have them do a joint petition, right?

3:52 >> Yeah, joint petitions rock, right? They’re cheaper, more affordable, they’re faster and then the best thing is you don’t hate your ex spouses guts. Okay, we got people all the time that come in and they do complaints. You serve the other spouse and they’re trying to kill that other person, right? I don’t want you going to jail for murder.
