2:32 >> So both parties were married. So what happens, you guys, is when both parties are married, or even if just one party is married. If you guys get married to each other, I know that’s kind of confusing. So please follow us. Alright. That marriage is what we call voidable, okay. V-O-I-D-A-B-L-E, it is voidable, okay. So technically in that occurrence, you guys, you can get it annuled. Okay, you want to seek an annulment, all right. What you’re going to want to do is you want to have proof that both spouses were married to another person, okay? And then you’re going to file the annulment paperwork. Now at our firm, okay, Vegas Divorce Pros, what we do is we prepare a complaints for annulments and in the alternative a divorce, okay. So basically we ask the judge to get the marriage annuled, okay. And then in the aspect that he or she doesn’t then we ask for a divorce. Okay? But it’s very, very, very important. As of the publication of this article (January 2020), the court filing fee is $299.00 to file a divorce in Clark County, Nevada.

This court filing fee differs in other Nevada counties — but is typically in the $250-$299 range though.

How Long Do You Have to Be Together to Be Common Law Married in Las Vegas?

The fair question to ask would probably be this:

“Are you legally married after living together for 7 years in the State of Nevada?”

Today an unprecedented portion of millennials will remain unmarried through age 40, a recent Urban Institute report predicted.

The marriage rate might drop to 70 percent — a figure well below rates for boomers (91 percent), late boomers (87 percent) and Gen Xers (82 percent).

So most people these days, choose to not marry, but just live together.

(Some folks call it “SHACKING UP!”)

Many times, older folks that may not want to give up their Social Security Benefits choose not to marry as well for obvious reasons.

However, it does NOT mean you are married after a certain amount of years together.

Very few states have a common-law marriage law and Nevada does NOT recognize common-law marriages in any form.

To be legally married you must obtain a Marriage License and go through a legal Ceremony.

If you are unmarried and have children together, you must obtain an order of custody, visitation, child support, medical coverage, etc., through the District Court Family Division if you decide to go your separate ways and terminate your relationship.

If you are unmarried and have bills and property together, those issues must be settled in a different court and not with the family court system.

Can Someone Divorce You Without YOU Knowing?

This happens WAY too much. Many people contact Vegas Divorce Pros, when they find that they were divorced without their knowledge.

Usually, it is a Complaint Divorce filed by the Plaintiff with the method of service by publication (not knowing the Defendant whereabouts), OR a complaint that was served and unanswered by the Defendant.

Is Adultery Illegal in Nevada?

The short answer to the question is “NO”.

Adultery in marriage, while obviously can be very distasteful is not illegal.

However, a judge may or may not look very unfavorable at a party if he/she was committing adultery (aka cheating) on their spouse and spent an excess amount of community property / money / funds on that person.

How Much Does a Divorce Cost in Las Vegas?

Compared to most other states in the U.S., it is fairly cheap to get a divorce in Las Vegas.

If your spouse is willing to agree to all of the division in regards to community property, debts and if you have minor child(ren), the visitation / custody / child support … you will do what is called a joint petition divorce (which is known as an uncontested divorce in other states).

What would need to happen is you and your spouse would need to do a Joint Petition divorce.

CAN I GET DIVORCED IN LAS VEGAS?

If you live in Las Vegas or perhaps if you live out of state (or country) and you were married in Las Vegas, you may be wondering if you can get divorced out here in Vegas.

The answer to that question is: “It really depends on your residency”.

You get divorced in the state that you are a RESIDENT of.

(not the state that you were married in as many people think)

Every state has different residency requirements for divorce, which usually are between 90 days to 1 year — before that state considers you a resident & allows you to get a divorce.

Nevada actually has one of the SHORTEST residency requirements for people wanting to get a divorce.

The residency requirement in Nevada is ONLY 6 WEEKS.

Meaning if you have been living in Las Vegas for at least 6 weeks and want to get a divorce, as long as you are going to keep living here in Nevada for the foreseeable future / you are allowed to get a divorce in the state.

How Do I Know if My Las Vegas Divorce is Final?

We know that feeling.

BUT HOW CAN YOU BE FOR SURE … that your Las Vegas Divorce is final?

#1- The judge will need to sign the Divorce Decree. Whether you are doing a Joint Petition Divorce or Complaint for Divorce — it doesn’t matter / the judge MUST sign the Decree before your divorce is finalized.

#2- You must e-file the Divorce Decree on Wiznet.

#3- If you’re still unsure whether your divorce has been finalized and you did it in Clark County, you can look it up online.

To check the website … click here to visit the family court website and select “Family Division”. Enter in your court case number or your name … and if you see that your case is “CLOSED” and there is “Decree of Divorce” listed in the documents filed, you are divorced.

Who Gets the House if I Get a Divorce in Las Vegas?

That is DEFINITELY a loaded question…

Nevada is what is called a “community property state”.

That means that in a divorce out here in Las Vegas each spouse (husband & wife) have 50% ownership of NOT only the home, but the property, assets and debt… provided that they were acquired DURING the course of the marriage.

So what does that mean you may ask?

It means that during a divorce out here in Las Vegas… if you bought the home DURING the course of the marriage, it can be up for grabs by your spouse in the Nevada divorce.

Typically for instance, if you owned the home BEFORE the the two of you were married… then it will be counted by the court as “Separate Property” and so it will not be up for grabs by your husband or wife.

So if you do have a house that is considered or locked in as “community property” … it REALLY makes financial sense for both you and your spouse to TRY to come to a mutually acceptable decision on what and HOW you want to do split the home.

Either sell it … refinance it … both of you remain living it … doesn’t really matter… the decision is yours… just come to an AGREEABLE decision what you want to do with the property.

(THAT IS THE BEST & MOST AFFORDABLE WAY FOR YOU TO MOVE FORWARD)
