So we’ve had a couple of cases, maybe two or three scenarios like that as matter of fact, a lady called us this morning about it, where a person is seeking a divorce from their spouse and the spouse dies. So there’s a couple of different scenarios that can happen in that case.

The first scenario is you and your spouse were contemplating getting a divorce, but you did not actually initiate the divorce, and then your spouse dies or you initiated the divorce, got the divorce papers filed, and then the spouse dies. So let’s talk about the first scenario you guys let’s talk about the scenario of, if you, your husband or your wife, unexpectedly passes away, R.I.P. God bless you, but you guys have not filed any divorce papers with the court.

So what happens is technically you guys are still married, all of the rules, and the laws regarding the custody and the visitation of your kids, would remain the same. So that’s obvious is going to go to you if your spouse dies, unless somebody contests that, such as a grandparent or whatnot.

Well, that’s a whole other story. In regards to your property and your debts you guy, that is going to roll with the probates side of things. So that’s going to be something that you want to talk to a probate attorney about. But in most cases guys, because that spouse died, you are going to get that property. You guys were married and nobody was contesting the assets or anything like that.

Now let’s talk about the scenario if you have initiated the divorce and then your spouse dies. So let’s say that you have filed the complaint about divorce with the court, you’ve paid your $299 court filing fee. Any issues that were of a contest or being fought out or litigated in regards to your divorce case, you guys, those are all going to become moot. M.O.O.T. because the spouse is dead.

So you’re going to typically get sole custody of the kids, there’s not going to be any visitation because obviously, your spouse is dead and because this is a community property States the property is going to go to you at least half of it. Now the other half of it that just kind of depends on the probate process.

This half that would have gone to your deceased spouse, it kind of depends on what they have done with wills or anything like that.
