How Do I Get a Divorce in Las Vegas?
You will need to determine whether you need to do a Joint Petition for Divorce in Las Vegas or a Complaint for Divorce in Las Vegas.
You will do a Joint Petition if both you and your spouse AGREE to all of the terms surrounding a typical divorce — such as property, debts, child custody, child support, visitation. This is sometimes called an uncontested divorce.
Both you and your spouse will need to sign and notarize the divorce documents to get this filed.
You will do a Complaint if only you are going to be signing the divorce papers. This is typically because EITHER you and your spouse do NOT agree on the terms surrounding your divorce or if your spouse is missing and you need to do a publication.
This is sometimes called a contested divorce (if your spouse refuses to sign the papers) or a publication divorce (if your spouse is missing).
The standard forms you will need are as follows:
- A Family Court Coversheet. This 1-page document will have all of the pertinent information concerning the names of the petitioners, plaintiff, defendant … as well as the addresses, phone numbers, attorney information and minor child(ren) if any.
- Joint Petition for Divorce or Complaint for Divorce. This is the document that is filed to the courthouse along with your $299 court filing fee. This document starts out the divorce and states what terms you are requesting from the court in regards to your divorce.
- Affidavit of Resident Witness. This form is signed by another Nevada resident and it states that that person knows that one of the parties has been a resident of the state of Nevada for at least 6 weeks and plans to continue living here for the foreseeable future.
- Decree of Divorce. This is the form that is signed and dated by the judge at the end of the divorce. Once it is signed / your divorce is finalized and this document is also called the “Final Decree”.
- Summons. Only if you are doing a Complaint. This document informs your spouse that once they are served with the Complaint, they have 20 days after the date of service to respond back to the court if they wish to contest the divorce.
- Affidavit of Service. Only if you are doing a Complaint. This document is filled out by the process server or 3rd party who served your spouse the Complaint and the Summons.
- Default. Only if you are doing a Complaint. This is the document that is filed after your spouse has been served and they have not responded within their 20 days of service.
- Summons. Only if you are doing a Complaint. This document informs your spouse that once they are served with the Complaint, they have 20 days after the date of service to respond back to the court if they wish to contest the divorce.
- Certificate of Mailing. This certificate is signed by a 3rd party stating that they mailed the Final Decree that was signed by the judge to the Co-Petitioner or the Defendant AFTER the divorce is over.
The Family Courthouse is located at 601 N Pecos Rd, Las Vegas, NV 89155 and their days and times of operation are 8:00 am to 4:00 pm Monday through Friday. They are closed on holidays.
