What’s the Difference Between a Las Vegas Annulment vs. Divorce?
Both an Annulment and a Divorce will effectively end your marriage.
Many times, people will want an Annulment over a divorce, because of religious beliefs (ie. they’re Catholic) … or because they are out-of-state residents who were married in Vegas … or because they’ve been married a very short amount of time.
But what exactly are the differences between a Las Vegas Annulment and a Las Vegas Divorce?
The FIRST main difference between the two is that the grounds for granting a Divorce are much EASIER than trying to prove the grounds for an Annulment.
The SECOND main difference between the two is that a Divorce terminates your marriage, while an Annulment goes back and invalidates the initial marriage, so it’s as if the marriage never happened.
(Think of the Thanos snap on Avengers Endgame, where he snapped his fingers and half the universe disappeared and it was like they never existed. Except this snap of the fingers makes your marriage disappear.)
The THIRD main difference between the two is with the Residency Requirement. With a Divorce, at least one of the parties must be a resident of Nevada (meaning that one of you have lived here for at least 6 weeks) …
… versus an Annulment where neither party needs to be a resident of Nevada (provided that you were married in Nevada).

What are the Grounds for a Las Vegas Annulment?
Remember how a little earlier on, we discussed about the Grounds for a Las Vegas annulment vs. divorce and the difficulties?
Let’s get you more information on that right now so that you can make an educated decision so you know how best to proceed.

Grounds for a Las Vegas Divorce. For our clients, we ALWAYS use “incompatibility” (NRS 125.010), which basically can mean anything. It could literally mean you want a divorce from your spouse for something as crazy as, because you don’t like the color of their eyes.
Provided that at LEAST one of you is a resident of Nevada, most of our current and past clients either choose to do a Divorce (because 99% of the time those are granted).
If we do prepare and file an Annulment for our clients who are residents of Nevada, we ALWAYS prepare what is called “Complaint for Annulment or in the Alternative a Divorce” (we know, that’s a super long name!)
This basically means you are asking the judge for an Annulment, but if he/she does not grant the Annulment, you want them to grant you the Divorce.
We do this option for our clients, because after all — the end result you want to get is the marriage ending, yes?

Grounds for a Las Vegas Annulment. You’re probably sick & tired of hearing us state that the grounds for a judge granting your annulment are more difficult to prove, but we have to tell you the good, bad & ugly so that you can make an educated decision, right?
There’s multiple grounds for Annulment that Nevada accepts (NRS 125.290 to 125.350), which in summary boil down to the following 5 grounds:
- Consanguinity. Marriage is VOID due to both Parties being of the same blood / or closely related family members.
— - Already Married to Someone Else. Marriage is VOID due to at least one of the parties was married to another person, at the same time of your new marriage.
— - Under Age. Marriage is VOIDABLE due to at least one of the parties being UNDER the age of 18 and you didn’t get the consent of a parent, guardian or the district court to get married.
— - Want of Understanding. (A popular choice). Marriage is VOIDABLE. At the time of the marriage, you were incapable of making a legal decision to get married AND were not in your right mind or sound mind. This could be due to intoxication, being under the influence of drugs, one of you were legally insane.

After you came to your right mind, both you and your spouse MUST not have continued to live together.

PLEASE NOTE: You must have actual proof of Want of Understanding happening (Written proof, sworn affidavits from a witness, etc) and also understand that many judges will refuse this ground and state that no justice of the peace in Nevada would grant two people who are drunk a marriage.
— - Fraud. (Another popular choice). Marriage is VOIDABLE. At the time of the marriage, your spouse fraudulently married you (ie. they deliberately misrepresented themselves in order to receive benefits to which they are not legally entitled, such as money, insurance proceeds, housing or public services, etc)

After you came to knowledge of the fraud, both you and your spouse MUST not have continued to live together.

PLEASE NOTE: You must have actual proof of Fraud happening (Written proof, sworn affidavits from a witness, etc).

If any of these Annulment grounds apply to you — then great! If not, you may want to consider getting a divorce in Las Vegas.
REMEMBER: To get a divorce in Las Vegas, one of the spouses must have resided in the State of Nevada for at least 6 weeks.
To prove residency, you must have (1) A Nevada physical address that is put down on your paperwork, (2) Another Nevada resident must sign an affidavit stating that they know you have lived in the state for at least 6 weeks.

How Much is a Las Vegas Annulment?
Let’s discuss the process that you go through to get an Annulment, then we’ll talk about the different packages you can get through our company, VEGAS DIVORCE PROS.
The Annulment Process.
#1 — We prepare your Las Vegas Annulment on state specific templates.
#2 — Both you and your spouse will sign the Annulment documents.
#3 — We will electronically file your documents with the Courthouse and pay your mandatory $269 court filing fee.
#4 — The judge will sign your Decree and your marriage will either be annuled (if the judge accepts the Annulment ground we put in) or dissolved (if the judge doesn’t accept the Annulment ground & decides to grant you the Divorce instead.
#5 — The total process for an Annulment typically takes approximately 2-3 months IF your spouse signs the documents OR if your spouse refuses to sign / but you give us their location to hire a process server to serve them the documents.
NOTE: If you are looking for a quicker process, a joint petition Divorce is the fastest way. Those take 2-3 weeks typically after we get all your papers filed.
#6 — The total process for an Annulment typically takes approximately 4-6 months IF your spouse is missing and we need to do a publication through the newspapers.
#7 — Annulments are not guaranteed. If the judge does not grant your Annulment, we will NOT give you a refund.
