What Are the Requirements to Get a Divorce in Las Vegas?

Compared to other cities and states across the nation — the requirements to get a Las Vegas divorce are pretty simple for the most part.
You can find the full summary of requirements in the Nevada Revised Statutes (aka… NRS 125.010 to NRS 125.185)
But in general these are the main requirements that you need to follow to get a divorce in Las Vegas:
- One of you must have lived in the state of Nevada for at least 6 weeks (and plan on living in the state for the immediate future)
- You will need a witness who is also a resident of Nevada who will sign an affidavit that states they know that you have lived here for at least 6 weeks.
- You can divide your property and debts anyway you see fit between the two of you generally.
However, if there is a dispute during your Las Vegas divorce, since Nevada is a community property state — the judge will typically divide it down the middle.
- Regarding child custody and visitation (if you two have minor children), the court typically lets you and spouse do whatever you agree on.
When it comes to child support — there are mandatory guidelines that you must follow in order to get the divorce approved though…
If one party has primary physical custody of the kids, the minimum child support that can be paid is $100/month per child.
If you don’t want to do the minimum, the standard calculation is 18% of gross monthly income (1 child), 25% of gross monthly income (2 children), 31% of gross monthly income (3 children) and 2% of gross monthly income for each additional child.
If you have joint physical custody — you subtract the lower income earning parent’s gross monthly income from the higher income parent’s gross monthly income — and then the parent who earns a higher income will be a percentage of the difference to the lower earning parent for the support of the kids.
You DO NOT need to have a Nevada or Las Vegas drivers license or utility bills to prove your residency.
Your spouse DOES NOT need to reside in Nevada or Las Vegas to get the divorce. Only ONE of you needs to be a resident of the state.
